Individual Non-Commercial License Agreement for AlkemyGUI Software

Software Description
The software referred to in this license agreement is a graphical user interface for a machine learning system called AlkemyGUI developed at The Australian National University (ANU) by Matthew Gray of the Research School of Information Sciences and Engineering (ANU).

License
In consideration of the user (licensee) accepting the terms of this license, a limited free license is hereby granted for the use of this software and its source for research and education purposes only.

Conditions of use
In consideration for the granting of this license, the licensee agrees to acknowledge the software and its developer in research or educational publications and other activities relating to the use of this software or its source. The licensee agrees not to remove this license agreement from the software or its source.

Restrictions
Use of any portion of this software or its source code for any commercial purposes or gain is prohibited under the terms of this license. The licensee may not rent, lease, sublicense, or make available for commercial purposes any portion of the software or its source. A separate license would need to be negotiated with the developer for any commercial purpose or use.

Limitation of Liability
No warranties as to performance or otherwise, whether expressed or implied, are provided. The developer shall not be responsible for, and shall not pay, any amount of incidental, consequential or other indirect damages arising from the use of software. The licensee agrees to indemnify the developer from any actions or damages arising from the licensee's use of the software.

Copyright
The developer and The Australian National University reserve all rights to the software and its source including copyright, intellectual property, and commercialization rights.

Severability
If any term of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then this Agreement, including all of the remaining terms, will remain in full force and effect as if such invalid or unenforceable term had never been included.
